DMCA Copyright Policy

USA Celebs respects the intellectual-property rights of others and complies with the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512. This page describes how copyright owners can submit a takedown notice and how affected users can submit a counter-notice.

How to file a DMCA takedown notice

If you believe that material on USA Celebs infringes a copyright that you own or are authorized to enforce, please send a written notice to the agent above containing all of the following (failure to include any item may delay or prevent action):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. A clear identification of the copyrighted work that you claim has been infringed (or, if multiple works are covered by a single notice, a representative list).
  3. The specific URL(s) of the material on USA Celebs that you claim is infringing, in enough detail for us to locate it.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. The following statement: “I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  6. The following statement, signed under penalty of perjury: “The information in this notification is accurate, and I am the copyright owner or am authorized to act on behalf of the copyright owner.”

On receipt of a complete and valid notice, USA Celebs will, in its discretion, expeditiously remove or disable access to the material in question and notify the user who posted it (if applicable).

How to file a counter-notice

If you believe material was removed by mistake or misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and email address, and a statement that you consent to the jurisdiction of the U.S. District Court for the Southern District of New York and that you will accept service of process from the original complainant.

Repeat-infringer policy

USA Celebs will, in appropriate circumstances, terminate the accounts and access of users determined to be repeat infringers.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please send a notice only if you genuinely believe in good faith that the law has been violated.
